Terms of Service

Medical Korea Service provides administrative and coordination services only. We are not a medical provider. These Terms govern your use of our services.

1. Acceptance of Terms

By engaging Medical Korea Service Co., Ltd. ("MKS", "we", "our"), you ("Client", "Patient", "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our services. Engagement begins when you initiate a conversation via WhatsApp, email, or any other channel and we acknowledge your inquiry.

2. Description of Services

MKS is a licensed International Patient Facilitator (License No. A-2014-01-01-1414, issued by the Mayor of Seoul). We provide the following administrative and coordination services:

  • Introduction to verified Korean medical specialists and hospitals within our network;
  • Coordination of consultations, appointments, and medical documentation;
  • Translation and interpretation support during the patient journey;
  • Travel and accommodation guidance (not booking);
  • Aftercare coordination and follow-up scheduling;
  • Liaison between Patient and the treating specialist or hospital where requested.
Core Principle — ADMINISTRATIVE AND COORDINATION SERVICES ONLY. MKS is not a healthcare provider, medical institution, hospital, or clinic. We do not employ physicians, surgeons, or other licensed medical personnel. We do not diagnose, treat, prescribe, or perform any medical procedure of any kind.

3. Scope & Limitations of Services

Our coordination services are limited to the activities expressly described in Section 2 and any written agreement between you and MKS. Any additional services require separate written confirmation. The hospital or specialist alone determines whether to accept you as a patient. We may decline to coordinate services where we believe doing so would not be in your best interest or would conflict with our professional standards.

4. What MKS Does Not Provide

You expressly acknowledge and agree that MKS does NOT:

  • Provide medical advice, diagnosis, treatment, or opinion of any kind;
  • Recommend specific surgical procedures, medications, or therapies;
  • Guarantee any medical outcome, aesthetic result, or recovery timeline;
  • Operate, own, or control any hospital, clinic, or medical facility;
  • Employ or supervise treating physicians, surgeons, anesthesiologists, or nurses;
  • Act as a party to your surgical consent or medical service agreement;
  • Provide emergency medical services or post-operative medical care.

All medical decisions are made directly between you and your treating physician, based on independent professional clinical judgment.

5. Patient–Physician Relationship

The patient–physician relationship is established directly between you and the treating specialist or hospital. MKS is not a party to that relationship. Surgical consent, treatment plans, prescriptions, and all medical decisions are matters between you and your physician.

You understand that the treating specialist, not MKS, is responsible for:

  • Pre-operative assessment and clearance;
  • The surgical or therapeutic procedure performed;
  • Anesthesia, intra-operative monitoring, and post-operative care;
  • Diagnosis of complications and clinical decisions following surgery.

6. Fees & Payments

MKS coordination fees are separate from, and in addition to, any medical fees charged by the treating hospital or specialist. Medical fees are paid directly to the medical provider in accordance with their own billing terms. MKS coordination fees, where applicable, will be clearly communicated in writing before services are rendered.

You are solely responsible for all medical costs, hospital charges, accommodation, travel, and incidental expenses. MKS does not receive commissions from medical providers in a manner that influences the matching of patient to specialist; matching is based on clinical and personal fit as described in our Method page.

7. Cancellation & Refund

You may cancel coordination services at any time by written notice (email or WhatsApp). Refund of any coordination fees already paid is subject to the following:

  • Cancellation more than 14 days before scheduled service: refund of all unused coordination fees, less reasonable administrative costs already incurred on your behalf;
  • Cancellation within 14 days of scheduled service: refund at MKS's reasonable discretion, accounting for non-recoverable third-party costs;
  • Medical fees paid to hospitals or specialists are governed by that provider's own refund policy, not by MKS.

We will act in good faith and provide a written breakdown of any deductions.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • MKS's total aggregate liability arising from or related to these Terms or the services shall not exceed the coordination fees actually paid by you to MKS in the six (6) months preceding the event giving rise to the claim;
  • MKS shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profit, loss of business, or loss of opportunity;
  • MKS shall not be liable for any act, omission, error, negligence, or breach by any treating hospital, specialist, anesthesiologist, nurse, hotel, airline, or other third party;
  • MKS shall not be liable for surgical outcomes, complications, side effects, scarring, asymmetry, dissatisfaction with aesthetic result, or any consequence inherent to a medical procedure.
Inherent Surgical Risk. Every surgical procedure carries inherent risks including but not limited to infection, bleeding, scarring, asymmetry, sensory changes, anesthesia complications, and rarely, more serious outcomes. You acknowledge that these risks are inherent to surgery itself, not caused by coordination services.

9. Indemnification

You agree to indemnify and hold harmless MKS, its officers, employees, and affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your interactions with any medical provider, hotel, airline, or other third party; (c) any false or misleading information you provide to MKS or to a medical provider; or (d) any consequence of a surgical or medical procedure performed by a third party.

10. Force Majeure

MKS shall not be liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to: natural disaster, fire, flood, pandemic, war, terrorism, civil unrest, governmental action, border closure, travel restriction, hospital closure, telecommunications failure, or other event of force majeure. In such event, MKS will act in good faith to mitigate impact and resume services when practical.

11. Confidentiality

MKS treats your personal and medical information with strict confidentiality in accordance with our Privacy Policy. We do not share patient information, photographs, surgical specifics, or identifying details for marketing or any other purpose without your explicit written consent. Our motto: "What happens in Korea, stays in Korea."

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or our services shall be resolved exclusively by the Seoul Central District Court (서울중앙지방법원), Republic of Korea, except where mandatory consumer-protection laws of your country of residence provide otherwise.

The parties will first attempt good-faith negotiation for at least thirty (30) days before initiating formal proceedings.

13. Amendments

MKS may update these Terms from time to time. Material changes will be communicated to you by email or by prominent notice on our website at least thirty (30) days before the change takes effect, except where shorter notice is required by law. Continued use of our services after the effective date constitutes acceptance of the amended Terms.
